Please read these terms of use carefully before using our game "Drive Beyond Horizons".
1. ACCEPTANCE OF TERMS
By downloading, installing, purchasing or playing "Drive Beyond Horizons" (hereinafter referred to as "the Game"), you agree to be bound by these Terms of Use. If you do not accept these terms, you must not use the Game.
2. LICENSE TO USE
Tacty Studio/Santor Games grants you a limited, non-exclusive, non-transferable and revocable license to download, install and use the Game for your personal and non-commercial use only, in accordance with these Terms of Use.
You are not permitted to:
- Copy, distribute or reproduce the Game without authorization
- Modify, adapt, translate or create derivative works based on the Game
- Decompile, disassemble or reverse engineer the Game
- Remove copyright notices or other proprietary notices
- Use the Game for commercial or profitable purposes without authorization
3. USER ACCOUNT
To access certain features of the Game, you will need to create a user account. You are responsible for maintaining the confidentiality of your account information and all activities that occur under your account.
You agree to:
- Provide accurate, current and complete information when creating your account
- Maintain and promptly update your account information
- Protect the security of your account and password
- Immediately notify Tacty Studio/Santor Games of any unauthorized use of your account
4. USER CONDUCT
When using the Game, you agree not to:
- Violate applicable laws or the rights of others
- Use the Game to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate
- Transmit viruses, trojans, worms or any other malicious code
- Interfere with or disrupt the integrity or performance of the Game
- Collect or track the personal information of other users
- Bypass, disable or interfere with the security features of the Game
- Use third-party programs, scripts or other means to gain an unfair advantage
5. PURCHASES AND DIGITAL CONTENT
The Game may offer the ability to purchase digital content or subscriptions. All purchases are final and non-refundable, unless required by applicable law.
Prices and availability of content may change at any time without notice. Tacty Studio/Santor Games reserves the right to limit purchase quantities.
6. USER-GENERATED CONTENT
In certain parts of the Game, you may create, upload, submit, store, send and receive content. By submitting content, you grant Tacty Studio/Santor Games a worldwide, non-exclusive, royalty-free, perpetual, irrevocable and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display such content in connection with the Game.
You represent and warrant that:
- You own or control all rights to the content you share
- The content does not violate these Terms of Use
- The content will not infringe the rights of third parties or cause harm to third parties
7. INTELLECTUAL PROPERTY
The Game and all its content, features and functionality are and will remain the exclusive property of Tacty Studio/Santor Games and its licensors. The Game is protected by copyright, trademark and other intellectual property laws.
All trademarks, service marks, trade names, logos and other identifiers appearing in the Game are the property of Tacty Studio/Santor Games or their respective owners.
8. UPDATES AND MODIFICATIONS
Tacty Studio/Santor Games may, from time to time, update, modify or revise the Game, including these Terms of Use, at our sole discretion. All changes take effect upon posting. Your continued use of the Game after posting of such changes constitutes your acceptance of the revised Terms of Use.
9. DISCLAIMER OF WARRANTIES
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TACTY STUDIO/SANTOR GAMES EXPRESSLY DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
TACTY STUDIO/SANTOR GAMES DOES NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE OR VIRUS-FREE, OR THAT DEFECTS WILL BE CORRECTED.
10. LIMITATION OF LIABILITY
IN NO EVENT SHALL TACTY STUDIO/SANTOR GAMES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, DATA OR USE) ARISING OUT OF OR RELATED TO THE USE OR INABILITY TO USE THE GAME.
11. TERMINATION
Tacty Studio/Santor Games may, at its sole discretion, suspend or terminate your access to the Game for any reason, including, without limitation, a violation of these Terms of Use.
12. GOVERNING LAW
These Terms of Use are governed by the laws of France, without regard to conflict of law principles.
